The chances of the Lindsay Clancy trial heading to a mistrial look to have increased again after the jury once again failed to deliver a unanimous verdict.<\/p>\n
After being\u00a0deadlocked in their decision\u00a0yesterday, the jury were urged by judge William F. Sullivan to continue their discussions.<\/p>\n
However, after today’s court proceedings (2 September), the jury have once again said that they cannot come to a decision regarding the 36-year-old’s fate, after she admitted to killing her three young children.<\/p>\n
Her defence team have argued that she was suffering from\u00a0postpartum psychosis\u00a0and therefore cannot be held criminally responsible for her actions, whereas the prosecutors suggest that she had\u00a0planned it out.<\/p>\n
The note said: \u201cAfter much deliberation we are still unable to come to a unanimous decision.\u201d<\/p>\n

Boston attorney Peter Elikann explained to the\u00a0New York Post\u00a0earlier this week that there is such thing as a \u2018Tuey-Rodriguez\u2019 charge, used to encourage a jury to come to a decision, which is what will now be employed by the judge as he looks to get a final decision.<\/p>\n
He said this is known as \u2018the dynamite charge\u2019 and added: \u201cit really pushes the jury and urges them to try to work out a unanimous decision. It\u2019s almost equivalent to a pep talk by the judge encouraging them to go back and try harder.\u201d<\/p>\n
Sullivan has issued that charge in the last few minutes.<\/p>\n

He read out a note which said: \u201cIn conferring together, you ought to pay proper respect to each other\u2019s opinions, and listen with an open mind to each other\u2019s arguments.<\/p>\n
“Thus, where there is disagreement, jurors for acquittal should consider whether a doubt in their own minds is a reasonable one, if it makes no impression on the minds of others who are equally honest, equally intelligent, and who have heard the same evidence, with the same attention, with an equal desire to arrive at the truth, and who have taken the same oath as jurors.”<\/p>\n
Typically, if a jury comes back at a deadlock again following a Tuey-Rodriguez then \u2018the judge is constrained to grant them a mistrial’.<\/p>\n
It is easy to see how the jury might be stumped on such a high-profile case which takes into account an alleged mental health condition, as well as Clancy’s own suicide attempt.<\/p>\n

Lindsay gives birth to her third child, Callan.<\/p>\n
She\u2019s open about her postpartum struggles with her other two kids on social media. Six weeks after Callan\u2019s birth, she posts that she\u2019s feeling \u2018dialed in\u2019 while focusing on exercise, nutrition, and mindset, and \u2018it has made all the difference\u2019.<\/p>\n
September 2022<\/p>\n
As the end of her maternity leave nears, Lindsay, who works as a labour and delivery nurse at Massachusetts General Hospital, starts to experience anxiety about returning to work.<\/p>\n
She visits two different psychiatrists and receives a diagnosis of generalized anxiety disorder.<\/p>\n
Lindsay is prescribed several different psychiatric medications.<\/p>\n
October 2022<\/p>\n
According to court docs, she writes in a note on her phone: \u201cI think I sort of resent my other children because they prevent me from treating Cal like my first baby. And I know that\u2019s not fair to them. I know that. I was feeling so depressed last evening when Cora and Dawson came home from school, I know it runs off on them, so we had a pretty rough evening, I want to feel love and connection with all my kids.\u201d<\/p>\n
December 2022<\/p>\n
Lindsay undergoes an evaluation at the Women and Infants Hospital Center for Women\u2019s Behavioral Health. She is not diagnosed with postpartum depression, prosecutors say.<\/p>\n
Lindsay\u2019s husband Patrick tells police she is having suicidal thoughts and thoughts of harming their children, according to his testimony in court.<\/p>\n
1-5 January, 2023<\/p>\n
Lindsay admits herself to McLean Hospital for psychiatric treatment. She is discharged after five days as clinicians do not believe she poses an imminent danger to herself or others, prosecutors say.<\/p>\n
22 January, 2023<\/p>\n
Lindsay, Patrick, Cora and Dawson have dinner at family friend Kyle Carney\u2019s home. Kyle later tells police that Lindsay \u2018seemed fairly normal\u2019.<\/p>\n
23 January, 2023<\/p>\n
According to prosecutors, Lindsay pens a note on her phone which says she has \u2018a touch of postpartum anxiety\u2019 about going back to work.<\/p>\n
24 January, 2023<\/p>\n
Prosecutors allege the following took place this day:<\/p>\n
Morning: Lindsay takes Cora to a scheduled pediatrician appointment. After returning home, they play in the snow with Dawson. She sends photos of the kids to Patrick and her mom.<\/p>\n
4:02pm: Lindsay searches for \u2018kids Miralax\u2019 (a laxative) on her phone, and 11 minutes later looks up \u2018take out 3v\u2019, referring to restaurant ThreeV in Plymouth. She uses Apple Maps to calculate how long it would take to drive from the family\u2019s home to ThreeV.<\/p>\n
4:47pm: Lindsay rings a CVS in Kingston to ask if they have any Miralax in stock. A manager tells her they don\u2019t, but they do have similar medications.<\/p>\n
The manager later tells authorities that she did not slur her words or sound impaired during the call.<\/p>\n
4:35pm: Lindsay texts Patrick, who is working from home: \u201cAny chance you want to do takeout from 3V \u2026 I didn\u2019t cook anything \u2026 It\u2019s been a long day.\u201d<\/p>\n
Patrick says yes, and Lindsay asks him to \u2018check the menu when you can\u2019.<\/p>\n
5:10pm: Lindsay calls ThreeV to place the order.<\/p>\n
5:15pm: Lindsay allegedly texts Patrick: \u201cPedialax liquid stool softener.\u201d He then leaves to pick up the medication.<\/p>\n
5:33pm: When Patrick arrives at CVS, he rings Lindsay, but she doesn\u2019t pick up. She rings back one minute later and confirms the medication.<\/p>\n
5:54pm: Patrick gets to ThreeV, pays for the food and leaves.<\/p>\n
6:09pm: Patrick returns home. \u201cThe first thing he noticed was the silence,\u201d prosecutors say. \u201cHe did not see or hear the defendant or the children.\u201d<\/p>\n
Patrick calls for his wife but gets no response. He discovers their second-floor bedroom is locked. Patrick eventually manages to get in the room but sees blood on the floor. He runs outside and finds Lindsay lying on the ground, according to prosecutors.<\/p>\n
6:11pm: Prosecutors say that Patrick rings 911 and Lindsay is saying: \u201cI tried to kill myself.\u201d<\/p>\n
He is then said to ask Lindsay: \u201cWhere are the kids?\u201d She responds: \u201cIn the basement.\u201d<\/p>\n
While on the call, Patrick goes down to the basement and is heard \u2018screaming in agony\u2019,<\/p>\n
Cora and Callan are discovered on the floor of the den. Dawson is found in his dad\u2019s home office.<\/p>\n
When officers arrive at the scene, Patrick alleges: \u201cShe killed the kids.\u201d<\/p>\n
Lindsay is taken to hospital, where she is treated for injuries that leave her paralysed below the waist. The three children are also rushed to hospital.<\/p>\n
7:28pm: Cora and Dawson are pronounced dead. Callan is medically flown to another children\u2019s hospital.<\/p>\n
25 January, 2023<\/p>\n
Police issue Lindsay an arrest warrant, charging her with two counts of murder, three counts of strangulation or suffocation, and three counts of assault and battery with a dangerous weapon.<\/p>\n
27 January, 2023<\/p>\n
Callan is pronounced dead at 11.18am.<\/p>\n
According to Assistant District Attorney Jennifer Sprague, Lindsay later wakes up and uses a whiteboard to ask: \u201cDo I need an attorney?\u201d<\/p>\n
6 February, 2023<\/p>\n
While in the presence of a psychologist hired by her lawyer, Lindsay calls Patrick and tells him she had a \u2018moment of psychosis\u2019 and heard \u2018a man\u2019s voice telling her to kill the kids and kill herself\u2019 after he left on January 24.<\/p>\n
7 February, 2023<\/p>\n
On the day of her arraignment, Lindsay\u2019s attorney says that she\u2019s still suicidal. She pleads not guilty to three counts of murder.<\/p>\n
October 2024<\/p>\n
Patrick asks the public to forgive Lindsay, telling\u00a0The New Yorker: \u201cI wasn\u2019t married to a monster – I was married to someone who got sick.\u201d<\/p>\n
January 2026<\/p>\n
Lindsay and Patrick\u00a0file\u00a0a civil lawsuit, accusing medical providers of not properly diagnosing, treating and monitoring her for a \u2018severe postpartum psychiatric condition\u2019.<\/p>\n
